Inspection Details
1. SCOPE OF INSPECTION: Client authorizes the Inspector to perform a standard visual home inspection of readily accessible areas, systems, and components at the given inspection address. The Client will be provided an overview of the apparent condition of the following elements at the time of the inspection: roofing, siding, trim, exterior, structure, insulation, ventilation, exhaust, interior, (flooring, walls, ceiling, windows, and doors), electric, plumbing, central air conditioning, heating, and appliances. The inspection is based upon the ASHI Standard of Practice. The inspection will include the above elements unless otherwise restricted by the Client or by accessibility. Any other comments or evaluations regarding areas other than those listed in the ASHI Standard of Practice are provided as a courtesy by the inspector. Items in large quantity or area such as receptacles, switches, fixtures, windows, hardware, mortar, masonry, paint, and caulk may be randomly sampled and not every instance of a minor defect may be noted. Inspections are performed with consideration given to the age of the system or component. Items marked OK are considered OK for the age of the item. Items in less than good condition will be marked as such, even though the condition may be normal for the age. Qualified contractors are recommended for all repairs. Any contractor referrals are based on the apparent integrity of the contractor and the Inspector has no financial interest nor any other affiliation with the contractor. Opinions vary from person to person and the report is the opinion of the inspector and must be considered as such.
2. CLIENT RESPONSIBILITIES: Client is encouraged to participate in the home inspection process. This is an excellent opportunity to learn about the home. Client participates at their own risk and the Inspector assumes no liability for personal injury or property damage resulting from client participation. Client assumes responsibility for missed information as a result of not participating in the inspection.
3. PROPERTY ACCESS: Approved access for entry onto the premises being inspected is assured by the Client. It is the responsibility of the Client to ensure that the utilities are on, appliances and equipment are operational, alarms are off, and all applicable areas are accessible at the time of inspection. Client further agrees to defend, indemnify and hold harmless the Inspector from demands or claims alleging a trespass upon the premises to be inspected.
4. PAYMENT: Check or Cash due at the end of the inspection.
5. CANCELLATION: Client may cancel the inspection at any time before the inspection date. A fee of $150 is due if the inspection is cancelled after the inspector is on site or if the Client fails to notify the Inspector of the cancellation. The Client may cancel the inspection after the inspection begins for a reduced rate.
6. REPORT: A pdf report is typically emailed within 24 hours.
7. LIMITATIONS: This is a non-invasive visual inspection. Client acknowledges there may be concealed or latent defects or deficiencies that cannot be seen and that the Inspector cannot insure against defects or deficiencies not noted in the report and later discovered by the Client. The report is not an exhaustive list of every minor defect and cannot precisely and completely assess all risks, detect all flaws, predict all future occurrences, or make any assurances. The Client acknowledges that the Inspector's rating is on material condition only.
The Inspector is not required to operate systems or components that are not permanently installed, that do not respond to normal operating controls, or which are shut off. The Inspector is not required to operate shutoff valves. The Inspector is not required to poke holes, lift carpets, or move personal property, furniture, equipment, appliances, insulation, plants, soil, snow, ice, or debris. The inspection is only good until the Inspector leaves the property. The Client acknowledges that property conditions can change after the inspection and that the Inspector is not responsible for changes, damages, repairs, equipment failures, or symptoms of problems that occur after the inspection. For this reason, no guarantees or warranties of any kind will be made by the Inspector.
The following items or conditions are not part of a home inspection and any comments regarding them are provided as a courtesy by the Inspector:
1)Any roof, attic, crawlspace, or other area deemed unsafe or inaccessible by the Inspector; 2) Multi-unit common areas; 3) Decorative items, paint, wallpaper, or treatments to walls, windows, floors, ceilings; 4) Recreational equipment, playgrounds, pools, spas, saunas; 5) Sheds/outbuildings 6) Window air conditioners, portable heaters, wood stoves 7) Motion or photo-electric sensors; 8) Concealed or private secured systems; 9) Water wells, septic systems, underground utilities; 10) Overflow drains and shower pans; 11) Heating system accessories or humidifiers; 12) Solar heating; 13) Heat exchangers; 14) Sprinklers; 15) Water purification or water softeners; 16) Central vacuum; 17) Telephone, intercom, cable TV, audio/video systems, antennae; 18) Lightning arrestors or load controllers 19) Elevators; 20) Manufacturer specifications, energy efficiency, recalls; 21) Thermostat/timer accuracy; 22) Chimney interiors/liners; 23) Synthetic siding; 24) Security or fire protection systems.
The following categories are not part of a home inspection and any comments regarding them are provided as a courtesy by the Inspector:
1) Compliance with regulatory requirements (building code, regulations, laws, ordinances, etc.); 2) Compliance with building plans or design; 3) The condition of systems or components that are not readily accessible; 4) The remaining life of any system or component; 5) The strength, adequacy, effectiveness, design, or efficiency of any system or component; 6) The causes of any condition or deficiency; 7) The methods, materials, or costs of corrections; 8) Future conditions including, but not limited to, the failure of systems or components. The suitability of the property for any specialized use; 9) The market value of the property or its marketability; 10) The advisability of purchase of the property; 11) The presence of diseases harmful to humans or potentially hazardous plants or animals, including, but not limited to, wood destroying organisms and mold; 12) The presence of any environmental hazards including, but not limited to, formaldehyde, toxic or flammable materials, urea, fungi, pests, carcinogens, noise, asbestos, lead-based paint, mold, radon, and contaminants in soil, water and air; 13) The effectiveness of any system installed or methods utilized to control or remove suspected hazardous substances; 14) The operating costs of systems or components; 15) The acoustical properties of any system or component; 16) The presence of components involved in manufacturer's recalls; 17) Soil, groundwater, or geological conditions.
8. WEATHER LIMITATIONS: Weather conditions may limit the extent of the inspection. Snow cover limits visibility and access to the roof, driveway, walkways, decks, and grounds. Rain may limit roof access. Dry conditions limit the ability to detect moisture problems, leaks, and property drainage. Cooling systems may not be able to be tested when the outside temperature has fallen below 60 degrees in the past 24 hours.
9. REINSPECTION: Components, systems, or areas not inspected due to weather limitations, utility shutoff, restricted access, or any other reason will NOT be reinspected as a part of this inspection. Client may schedule a new inspection for any component, system, or area for an additional fee. A reinspection on any repairs done after the original inspection is not part of this inspection and is also an additional fee.
10. LIABILITY: The Inspector shall have no liability for the cost of repairing or replacing any items found, or not found, to be currently or later defective or deficient, or for any related costs of property damage, consequential damage, or bodily injury. The liability of the Inspector is limited to the terms and conditions as set forth in this contract between the Inspector and the Client. The Client expressly releases the Inspector from any and all claims arising outside of this contract. Client agrees to indemnify and hold the Inspector harmless and blameless for any damages and/or expenses, to include legal fees, involved in defense of any claim made by a third party as the result of services rendered under this contract.
11. DISPUTE RESOLUTION: Client agrees to notify the Inspector in writing within 72 hours if client feels there was an error, omission, or deficiency in the inspection report. In the event that the Client feels that an installed system or component which was inspected by the Inspector was not in the condition reported by the Inspector, the Client agrees to notify the Inspector 72 hours prior to any repair or replacement of said system or component and make the property available for reinspection. Any repairs, alteration, or replacement of said system or component before notifying the Inspector voids the Client's right to file a claim. Client agrees that the Inspector is liable only if the Inspector fails completely to adhere to the standard defined in this contract. Any legal action must be brought within 2 years from the date of the inspection or it will be deemed waived and forever barred. Client agrees that the Inspector's total liability is limited to the cost of the inspection.from all damages, expenses, costs, and attorney fees arising from such a claim.
12. THIRD PARTY DISCLOSURE: Client fully understands that the information contained in the inspection report is for the use of the Client only. Client grants consent to authorize the Inspector to disclose report information to any third party involved in the transaction. In the event that any third party makes a claim against the Inspector arising from the services provided to the Client in this report, Client agrees to indemnify, defend, and hold harmless the Inspector from all damages, expenses, costs, and attorney fees arising from such a claim.
13. CONTRACT: This contract, with its terms, conditions, and disclosures, constitutes the entire agreement between the Inspector and the Client. Both parties agree that there is no representation, statement or agreement not set forth herein or incorporated by reference. No waiver, alteration, or modification of this contract shall be valid unless it is in writing and signed by an authorized representative of both parties. This contract shall be construed and governed by the laws of the Commonwealth of Virginia. If any legal entity determines that any portion of this contract is void or unenforceable, then the remainder of the contract shall be enforced as if the unenforceable portion did not exist.
14. SIGNATURE: The Client and the Inspector have read, understand, and accept the terms and conditions of this inspection contract. The Client and Inspector sign the contract on their own free will.
